Terms and Conditions

This English version is provided for convenience only. The German version is legally binding.

1. Scope

(1) These General Terms and Conditions (GTC) apply to all contracts that you conclude with us through our online shop wohnungstechnik.de. Any differing terms of customers apply only if we expressly agree to them.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or independent professional activity (§ 13 BGB, German Civil Code). A trader is a natural or legal person or a partnership with legal capacity that, when concluding the contract, acts in the exercise of its trade, business, or independent professional activity (§ 14 BGB).

2. Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

(2) This is how the ordering process works: You place the desired items in the shopping cart and enter the ordering process via the "Check out" button. There you enter your contact and delivery details and choose the shipping and payment method. Before submitting, you see all details once more in an overview. You can correct input errors at any time by changing the fields directly or by going back to the shopping cart. By clicking the "Pay now" button, you submit a binding offer to purchase the goods in the shopping cart.

(3) After we receive your order, you will receive an automatic email confirming its receipt. This confirmation of receipt does not yet constitute acceptance of your offer. The contract is concluded when we accept your order by a separate email (order or shipping confirmation) or ship the goods to you, but no later than when the purchase price is charged or collected via the payment method you selected. If we do not accept your offer within two business days, you are no longer bound by it. In that case, we will refund any payments already made without undue delay.

(4) We store the contract text. You will receive the order details with the order confirmation by email, and you can access and print these GTC on this page at any time. If you have created a customer account, you will also find your orders there.

(5) The language of the contract is German.

3. Prices and Shipping Costs

(1) All prices are final prices in euros and include statutory value added tax (VAT).

(2) Shipping costs apply in addition to the price of the goods:

• Germany: €4.99 per order; for orders of €100 or more, we deliver free of shipping costs.
• Countries of the European Union: a flat rate of €19.99 per order.
• Freight items: For bulky items delivered by freight carrier, we show the shipping costs separately in the ordering process before you submit the order.

(3) If the value of the items from the manufacturer AFPRO Filters in your order is below €200.00, we charge an additional small order surcharge of €20.00 including VAT, once per order. The relevant amount is the total price of these items after item discounts, excluding shipping costs. Items from other manufacturers are not counted. If the AFPRO goods value is €200.00 or more, no surcharge applies. It is shown in the cart and during checkout as a separate line item “Small Order Surcharge” before you submit your order, and it also applies if shipping is free of charge.

(4) You can find details in our Shipping Terms. No customs duties apply to deliveries within the European Union.

4. Delivery

(1) We deliver to Germany and to the following countries of the European Union: Belgium, Bulgaria, Denmark, Estonia, Finland, France, Greece, Ireland, Italy, Croatia, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Austria, Poland, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, the Czech Republic, Hungary, and Cyprus. Deliveries to other countries are only possible by prior arrangement.

(2) The delivery time is stated on the respective product page. It begins on the day after the contract is concluded. If the end of the delivery time falls on a Saturday, Sunday, or public holiday at the place of delivery, it is moved to the next business day. If you order several items with different delivery times, we deliver in partial shipments or all together according to the longest delivery time.

(3) We ship many items directly from the manufacturer or wholesaler. Partial deliveries do not incur any additional shipping costs for you.

(4) If, contrary to expectations, an ordered item is not available, we will inform you without undue delay. We will refund any payments already made for unavailable items without undue delay. Your statutory rights remain unaffected.

(5) If goods are delivered with obvious transport damage, please report such damage to the delivery person as soon as possible and let us know. If you do not do so, this has no consequences for your statutory claims as a consumer. However, it helps us to enforce our own claims against the transport company.

5. Payment

(1) The available payment methods are shown to you in the ordering process. They depend on the country of delivery and on your device. We currently offer in particular: credit card (Visa, Mastercard, Maestro, American Express), PayPal, Klarna, Apple Pay, Google Pay, and Shop Pay. For certain countries of the European Union, local payment methods such as Bancontact, EPS, BLIK, or MobilePay are also available.

(2) The purchase price is due upon conclusion of the contract. For payment via Klarna (for example, purchase on invoice or installment purchase), the terms of Klarna shown to you in the ordering process apply in addition.

6. Retention of Title

(1) In relation to consumers, the goods remain our property until full payment has been made.

(2) In relation to traders, we retain title to the goods until all claims arising from the ongoing business relationship have been settled in full. You may resell the goods in the ordinary course of business. You hereby assign to us, already now, the resulting claims against third parties in the amount of the respective invoice total, and we accept this assignment. You remain authorized to collect the claims as long as you meet your payment obligations toward us.

7. Right of Withdrawal

(1) As a consumer, you have a statutory right of withdrawal. You can find details in our withdrawal policy.

(2) You can also declare your withdrawal directly online: via the "Withdraw from contract" button, which you will find in the footer of every page of our shop. We will confirm receipt of your withdrawal to you by email without undue delay.

(3) Traders are not entitled to a statutory right of withdrawal.

8. Liability for Defects

(1) The statutory law on liability for defects applies.

(2) In relation to traders, the limitation period for claims based on defects in new items is twelve months from delivery. This does not apply to claims for damages under Section 9 or to recourse claims under § 445a BGB. For merchants, the duty to inspect and give notice of defects under § 377 HGB (German Commercial Code) applies.

(3) A guarantee exists only if it is expressly stated, for example as a manufacturer's guarantee under the manufacturer's guarantee terms. This does not restrict your statutory rights.

(4) Many of our products, such as electrical appliances and heating, air conditioning, and ventilation systems, may only be connected and put into operation by qualified professionals. Please observe the manufacturers' installation and safety instructions.

9. Liability

(1) We are liable without limitation for damages resulting from injury to life, body, or health, in cases of intent and gross negligence, in cases of fraudulent concealment of a defect, within the scope of a guarantee we have assumed, and under the German Product Liability Act (Produkthaftungsgesetz).

(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for the contract. Essential contractual obligations are obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely.

(3) Otherwise, our liability for slightly negligent breaches of duty is excluded.

(4) These provisions also apply in favor of our legal representatives and vicarious agents.

10. Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG, German Consumer Dispute Resolution Act).

11. Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive you of the protection granted by mandatory provisions of the law of the country in which you have your habitual residence.

(2) If you are a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Stuttgart.

(3) Should individual provisions of these GTC be invalid, the remainder of the contract remains valid.

12. Information on Waste Electrical Equipment and Batteries

(1) Electrical and electronic equipment marked with the crossed-out wheeled bin symbol must not be disposed of with household waste. Please hand in old equipment separately from unsorted municipal waste, for example free of charge at the collection points of the public waste management authorities (recycling centers) near you.

(2) Before handing in old equipment, remove any waste batteries and waste accumulators that are not enclosed by the device, as well as any lamps that can be removed without being destroyed, and dispose of them separately. You are personally responsible for deleting any personal data on old equipment.

(3) Waste batteries do not belong in household waste. You can return them free of charge at municipal collection points or to retailers. The crossed-out wheeled bin symbol on batteries means that they must be collected separately. The symbols Cd, Hg, or Pb below the symbol stand for cadmium, mercury, or lead.
