2. Overview and Legal Bases
We process personal data only to the extent that a legal basis exists. In particular, these are:
- Art. 6(1)(a) GDPR (consent; GDPR refers to the EU General Data Protection Regulation), for example for statistics and marketing cookies,
- Art. 6(1)(b) GDPR (contract and pre-contractual measures), for example for orders, delivery and payment,
- Art. 6(1)(c) GDPR (legal obligation), for example for retention under tax and commercial law,
- Art. 6(1)(f) GDPR (legitimate interest), for example for the secure and stable operation of the shop.
In addition, § 25 TDDDG (German Telecommunications Digital Services Data Protection Act) applies to storing information on your device and accessing that information. Technically necessary storage takes place under § 25(2) no. 2 TDDDG, and all other storage only with your consent under § 25(1) TDDDG.
3. Hosting and Shop System (Shopify)
Our online shop runs on the Shopify platform. The provider for customers in Europe is Shopify International Limited, Victoria Buildings, 1 to 2 Haddington Road, Dublin 4, D04 XN32, Ireland. Shopify processes the data on our behalf (data processing agreement under Art. 28 GDPR).
When you access our pages, data transmitted by your browser is processed automatically: IP address, date and time, page accessed, referrer, browser, operating system and device information. This is necessary to deliver the website and to ensure its security and stability (Art. 6(1)(f) GDPR).
Shopify also processes data in Canada and in the USA. For Canada, an adequacy decision of the European Commission is in place. Transfers to the USA are based on the EU-US Data Privacy Framework, under which Shopify is certified, and additionally on standard contractual clauses of the European Commission. You can find further information in Shopify's privacy policy at shopify.com/legal/privacy.
4. Cookies and Consent
We use cookies and similar technologies. We use technically necessary cookies, for example for the shopping cart, checkout, session, language setting and saving your cookie selection, without consent (§ 25(2) no. 2 TDDDG, Art. 6(1)(b) and (f) GDPR).
We only set cookies for preferences, statistics and marketing if you have agreed to them in the cookie banner (§ 25(1) TDDDG, Art. 6(1)(a) GDPR). The banner is provided via Shopify's privacy feature. You can change or withdraw your consent at any time with effect for the future via the “Cookie Settings” link in the footer of every page.
5. Orders and Customer Account
When you place an order, we process the data you provide during the ordering process: name, shipping and billing address, email address, telephone number and company if you choose to provide them, the items ordered, and payment and shipping information. We use this data to perform the contract, to keep you informed about your order and to deliver the goods (Art. 6(1)(b) GDPR). You will receive the order confirmation and the shipping confirmation by email.
You can create a customer account to view your orders and save addresses. This is voluntary. You can have the account deleted at any time.
We retain contract and invoice data for six or ten years, respectively, in accordance with the provisions of commercial and tax law (§ 257 HGB (German Commercial Code), § 147 AO (German Fiscal Code), Art. 6(1)(c) GDPR).
6. Payment Service Providers
To process the payment, we pass on the data required for this purpose to the payment service provider you choose during the ordering process (Art. 6(1)(b) GDPR):
- Shopify Payments for credit cards and local payment methods, operated in cooperation with Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland.
- PayPal: PayPal (Europe) S.à r.l. et Cie, S.C.A., 22 to 24 Boulevard Royal, L-2449 Luxembourg.
- Klarna: Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. For purchases on invoice or in installments, Klarna checks your identity and creditworthiness and may consult credit agencies for this purpose. Klarna makes this decision under its own responsibility; you can find details in Klarna's privacy notice, which is shown to you during the ordering process.
- Apple Pay: Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland.
- Google Pay: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
- Shop Pay: Shopify (see Section 3).
The payment service providers process your data partly under their own responsibility and in some cases also outside the EU. Their respective privacy notices apply.
7. Shipping, Direct Delivery and Shipment Tracking
For delivery, we pass on your name and your shipping address to the shipping company (Art. 6(1)(b) GDPR). We ship parcels with DHL (Deutsche Post AG and DHL Paket GmbH, Charles-de-Gaulle-Straße 20, 53113 Bonn). We create the shipping labels via the Shopify app easyDHL. For goods delivered by freight forwarder, the freight forwarder additionally receives your telephone number so that delivery can be coordinated.
Many items are delivered directly to you by the manufacturer or wholesaler. For this purpose, they receive only your name, your shipping address and, for goods delivered by freight forwarder, your telephone number.
Where DHL notifies you of the delivery by email, we transmit your email address for this purpose (Art. 6(1)(f) GDPR; our legitimate interest is smooth delivery). You can object to this at any time.
For shipment tracking and shipping notifications, we use the services AfterShip (AfterShip Limited, Hong Kong) and 17TRACK (17TRACK Network Technology Co., Ltd., Shenzhen, China). In the process, the tracking number, shipping service provider, place of delivery and, where applicable, your email address are processed. When you access the pages, a script from AfterShip that provides shipment tracking may be loaded. There is no adequacy decision of the European Commission for Hong Kong and China; the transfer takes place on the basis of standard contractual clauses. The legal basis is Art. 6(1)(b) and (f) GDPR; our legitimate interest is providing reliable information about the delivery status.
8. Product Reviews (Judge.me)
We use the Judge.me service for product reviews. When you submit a review, your name, the review, any photos and your email address are processed. Your name is published together with the review; your email address is not. The legal basis is Art. 6(1)(a) GDPR.
After a purchase, Judge.me may send you an email on our behalf asking for a review. You can object to this at any time, for example via the unsubscribe link in the email or by sending us a message. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is obtaining genuine customer opinions about our products.
9. Google Analytics 4
If you have consented to statistics cookies, we use Google Analytics 4 from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics is integrated via Shopify's “Google & YouTube” sales channel and records how visitors use our shop, for example pages viewed, time spent on the site, origin, device and purchase transactions. Google Analytics 4 does not store IP addresses. We use Google Consent Mode; without your consent, no analytics cookies are set.
The legal basis is your consent (Art. 6(1)(a) GDPR, § 25(1) TDDDG). Google may also process data in the USA; Google is certified under the EU-US Data Privacy Framework. The data is deleted after 14 months. You can withdraw your consent at any time via the cookie settings.
10. Google Shopping and Meta
Our products appear in Google Merchant Center and in Google Shopping via the “Google & YouTube” sales channel. For this purpose, we transmit product data, but no personal data of our customers. If you have consented to marketing cookies, the Google tag measures whether a visit via a Google ad has led to a purchase (Art. 6(1)(a) GDPR).
Via the “Facebook & Instagram” sales channel, we provide our product catalog to Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland. A Meta pixel is only loaded if you have consented to marketing cookies (Art. 6(1)(a) GDPR). Meta may also process data in the USA; Meta is certified under the EU-US Data Privacy Framework.
11. Fonts
The fonts used on our pages are loaded locally from our shop server or via the content delivery network of our shop provider Shopify. No connection to servers of Google or other font providers is established.
12. Contact via Form, Email or Phone
If you contact us via a contact form, the product question form, by email or by phone, we process your details in order to answer your inquiry (Art. 6(1)(b) GDPR for inquiries about orders and offers, otherwise Art. 6(1)(f) GDPR). Messages from the forms are transmitted to us via Shopify. Our email mailbox is operated by netcup GmbH, Daimlerstraße 25, 76185 Karlsruhe. We delete the data once the inquiry has been dealt with and no retention obligations apply.
13. Online Withdrawal
You can withdraw from a contract online using the “Withdraw from contract” button. In doing so, we process your name, your order number, your email address and your optional message in order to handle the withdrawal and to confirm its receipt to you by email. The legal basis is Art. 6(1)(b) and (c) GDPR. We retain this information together with the order documents.
14. Newsletter
If you subscribe to our newsletter, we will send you information about products and offers by email. Subscription takes place using the double opt-in procedure, which means you confirm it via a link in an email. We use Shopify Messaging for sending. The legal basis is your consent (Art. 6(1)(a) GDPR). You can unsubscribe from the newsletter at any time via the unsubscribe link in every email.
15. Sales via Online Marketplaces
We also offer individual products on online marketplaces. If you buy there, we receive from the marketplace the data we need to process your order (Art. 6(1)(b) GDPR). The privacy notice of the respective marketplace applies in addition.
16. Storage Period
We store personal data only for as long as is necessary for the respective purpose or as required by statutory retention periods. After that, the data is deleted or, until the periods expire, restricted in its processing.
17. Your Rights
You have the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR). You can withdraw any consent you have given at any time with effect for the future (Art. 7(3) GDPR).
Right to object: If we process data on the basis of a legitimate interest (Art. 6(1)(f) GDPR), you can object at any time on grounds relating to your particular situation (Art. 21 GDPR). You can object to processing for direct marketing purposes at any time without giving reasons.
You can lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg (State Commissioner for Data Protection and Freedom of Information of Baden-Württemberg), Lautenschlagerstraße 20, 70173 Stuttgart.
18. Further Information
To conclude a contract, you must provide the data marked as mandatory; without this information, we cannot carry out the order. We do not use automated decision-making under Art. 22 GDPR. An exception to this may be the credit check carried out by Klarna (see Section 6).
For security reasons, our website uses SSL or TLS encryption.
